TERMS & CONDITIONS

1.            Scope

The following Terms and Conditions for registration to the droidcon Greece conference (hereinafter referred to as “Event”) of Young Entrepreneurs of Thessaloniki, 15, Spartis St | 56224 Kordelio – Evosmos, Thessaloniki, GR (hereinafter referred to as “YET”) apply with regard to the purchase of admission tickets (hereinafter referred to as “Ticket(s)”) or to the registration of visitors, sponsors, speakers or partners (jointly hereinafter referred to as “Attendee”) for the Event. With the purchase of the Tickets or the registration of the Attendee, the purchaser of the Ticket (hereinafter referred to as “Customer”) or the registering Attendee accepts these Terms and Conditions. Counter-confirmations by the Customer referring to Customer´s own business or purchasing conditions are hereby expressly contradicted. Deviations from these Terms and Conditions shall only be effective if they have been confirmed in writing by YET.

2.            Conclusion of Agreement

2.1         YET uses the platform of Eventbrite, Inc., 155 5th Street, Floor 7, San Fran-cisco, CA 94103, Reg. No. 4742147, U.S.A. (hereinafter referred to as “Eventbrite”) to sell tickets or register Attendee in the Event. The agreement for the purchase of Tickets shall only be concluded between YET and the Customer as follows:

2.2         YET offers the Customer various ticket categories via the official event website (https://www. droidcon.gr). Customer will be forwarded to official website of Eventbrite (hereinafter referred to as “Ticket Website”). After entering the requested order data , Customer accepts the contractual offer by clicking the “Pay now” button. Hereby, Customer confirms these Terms and Conditions and taking note of the data protection information of YET in accordance with the EU–General Data Protection Regulation as well as Terms of Service and Privacy Policy of Eventbrite.

3.            Confirmation, Tickets

3.1         After booking and fulfilling its payment obligation, Customer or registered Attendee will receive a confirmation e-mail from Eventbrite with the Ticket for self-printing (Print@home ticket) and as a Mobile Ticket (Passbook/Wallet App). Admission to the Event is granted exclusively with this Print@home Ticket or Mobile Ticket.

3.2         The resale of Tickets is prohibited. In the event of a breach of the above provision, YET shall in particular be entitled to block the Ticket in question and refuse to allow the ticket holder to participate in the Event without compensation, shall also refuse to sell Tickets to the person concerned in the future and to issue a ban on entering the premises.

4.            Prices, payments

4.1         The current prices for the respective ticket category can be seen on the Ticket Website and are displayed when selecting the type and number of Tickets to be purchased. The prices quoted on the Ticket Website at the time the order is placed shall apply. The statutory value added tax is included in the total price.

4.2         Unless otherwise agreed, the Customer shall pay the amount stated in Customer’s or-der by the means of payment chosen in advance. The purchase price for the Tickets is due for payment immediately and without deductions after conclusion of this agreement. Partial or installment payments are not permitted. The fulfillment of the Customer’s payment obligation only occurs with crediting to one of the bank accounts of Eventbrite.

5.            Sponsor, Speaker and Partner Tickets

Sponsor, Speaker or Partner will receive an access code to be entered at the Ticket Website. The Tickets will be either free of charge (Sponsor or Speaker) or a negotiated discount (Partner) will apply.

6.            Right of cancellation

6.1         YET grants Customer or registered Attendee a right of cancellation until 30 days before the Event´s start day. In order to cancel its participation in due time, Customer or registered Attendee must send an e-mail to [email protected] Decisive for determination of the timely receipt of the notice of cancellation is the date of receipt.

6.2         In the event that the right of cancellation is effectively exercised, the relevant Ticket(s) will be blocked so that entry to the respective Event will not be possible. In the event of cancellation having become effective the relevant Ticket(s) refund will automatically be paid within 30 days after the event took place and after the ticket become null , Customer shall provide YET with the banking details in order to arrange for a refund via wire transfer.

7.            Liability, Force Majeure

7.1         YET shall have unlimited liability for damage suffered by the Customer or registered Attendee only if such damage is attributable to willful intent or gross negligence on the part of YET. In the event of minor negligent breaches of duty, YET shall only be liable for a breach of one of its essential contractual obligations (cardinal obligation). In this case, the liability of YET shall be limited to the contractually typical and foreseeable, direct damage to the Customer or registered Attendee at the time of conclusion of the agreement. This shall also apply to breaches of duty by legal representatives and/or vicarious agents of YET. Liability for culpable injury to life, limb or health shall remain unaffected by this limitation of liability.

7.2         YET shall not be responsible for disturbances, delays and/or damage caused by force majeure, in particular natural phenomena.

8.            Postponement / Cancellation of the Event

8.1         If an event is postponed, the Tickets for the new event date automatically remain valid. A rewriting/replacement is not required.

8.2         Tickets may not be returned or refunded unless the Event is cancelled without replacement. In this case, YET will reimburse the costs actually incurred for the Ticket. Expenses and further costs will not be reimbursed.

9.            Special conditions for congresses, seminars, workshops, meetings and conferences

9.1         YET reserves the right to replace announced speakers with others and to make necessary changes to the event program and venues while preserving the overall character of the Event. If it is not possible to organize a part of the Event due to force majeure, the absence of a speaker, disruption at the Event or a low number of attendees, the Attendees will be informed immediately.

9.2         Event-related lectures and documentation are protected by copyright and may not be reproduced, distributed or commercially used in any form – not even in part – without the consent of YET and the respective speakers. All film and sound recordings intended for the duration of the Event require the prior permission of YET. Photographs are not permitted. YET assumes no responsibility or liability whatsoever for any inaccuracies in the content of the lectures and documentation or for their conformity under trademark and copyright law.

9.3         YET works to create a comprehensive overview of the interactions and events that may be of promotional interest to the Event. Accordingly, please be advised that you may be filmed or photographed at any time and any presentations you deliver may be recorded. If you do not wish to be filmed, photographed or recorded, please advise YET and/or legal representatives and/or vicarious agents before-hand.

10.         Data protection

10.1       YET processes the personal data of Customer and registered Attendees in compliance with the relevant data protection regulations. Personal data (in particular name, address, e-mail address) shall be collected, processed and used by YET to the extent necessary to establish, structure, amend or fulfill the contractual relationship.

10.2       YET shall be entitled to transfer the data to third parties commissioned by it with the execution of the agreement, to the extent that such transmission is necessary in order for the agreement for participation in the Event to be fulfilled or for the Event to be able to offer further services in connection with the Event. The Customer or Attendee shall be informed of this and of his/her right of revocation in the course of the ordering process by confirming that he has read and understood the data protection information in accordance with the EU-General Data Protection Regulation

11.         Online Dispute settlement platform

11.1       The European Commission provides a platform for out-of-court on-line dispute resolution (OS platform), which can be accessed at www.ec.europa.eu/Consumers/Odr YET’s contact details, including e-mail address, can be found in the imprint on the Event’s website.

11.2       YET is neither obliged nor willing to participate in the dispute resolution procedure.

12.         Visa Requirements

12.1       It is the sole responsibility of the Attendee to take care of his/her visa requirements. Attendees who require an entry visa must allow sufficient time for the application procedure. Attendees should contact the nearest embassy or consulate to determine the ap-appropriate timing of their visa applications.

12.2       YET will not directly contact embassies and consulates on behalf of visa applicants.

13.         Miscellaneous

13.1       Should individual provisions of these Terms and Conditions be ineffective, the validity of the remaining provisions shall not be affected. The invalid provision shall be amended in such a way that the intended purpose is achieved.

13.3       The Greek Law shall apply exclusively with the exclusion of the UN Convention on Agreement for the International Sale of Goods.

13.4       The place of fulfillment and jurisdiction for all disputes in connection with this contractual relationship shall be Thessaloniki, provided that the Customer or Attendee is a merchant, a legal entity under public law or a special fund under public law or if at least one of the contracting parties does not have a general place of jurisdiction of Greece.

The use of your personal data, which you make available to us through your ticket purchase, only takes place for the purposes stated in this data protection information, which supplements the general Data Protection Policy.

2. Categories of personal data

The following categories of personal data will be collected during your ticket purchase:

2.1         Ticket buyer data

In order to buy a ticket you can either use your “Eventbrite Account” or enter your buyer data. The following data will be requested: first name, last name and email address.

2.2         Tax Receipt Information

The information required for the tax receipt depends on the type of registration:

2.2.1      Registration as an Individual

If you register as an individual the following data will be required for the tax receipt: first name, last name and email address.

2.2.2      Registration as a Business

If you register as a business the following data will be required for the tax receipt: first name, last name and email address.

2.3         Invoice Billing Information

In case you will need an invoice (and only if you opted it when purchasing a ticket on Eventbrite), as your billing information we will ask you to provide us the following data: country, address, city, state/province (optional) and postal code. The invoice will be issued within 30 days after the event finished

2.4         Ticket data

Tickets for the .droidconGreece 2019 are always personalized, therefore the following data must be provided for every ticket purchased: first name, last name, e-mail, gender and date of birth.

3             Purpose and legal basis of processing

3.1         We process your personal data pursuant to Sections 2.1. to 2.4 for the establishment and performance of your contractual relationship with YET on the legal basis of Art. 6 para. 1 sentence 1 lit. b) GDPR.

3.2         Furthermore, we use your personal data for the purpose of contacting you in order to provide you with information accompanying the droidcon and information on subsequent events. Subsequent events also include other events organized or held by YET or any other affiliated company in Greece and abroad. In particular we will use the email addresses of the ticket users to offer them the subscription to our “Droidcon Newsletter” and the access to the “Droidcon Community Platform”. For these purposes, we also forward your data to other partners of YET. This is based on Art. 6 para. 1 sentence 1 lit. f) GDPR. The justified interest lies in the optimal support of our customers during and after the droidcon and the promotion of identical and similar products from the event portfolio of YET and its partners. Please note that you are entitled to this right of objection (see below “Your Rights”).

3.3         We use the some of the requested information especially your gender and date of birth for statistical purposes and for our public relations work. They are used for the optimal further development of the droidcon and informing the public about the composition of our visitors. The basis for this processing is the legitimate interest of YET (Art. 6 para. 1 sentence 1 lit. f) GDPR in optimally organizing its events and in satisfying the public’s interest in information. Please note that you are entitled to this right of objection (see below “Your Rights”).

3.4         We regularly invite our visitors to participate in voluntary and anonymous online surveys in order to continuously improve our products and services and adapt them to your needs. In doing so, we will use the data provided in the ticket purchase process (Section 2.4) to contact our visitors. The legal basis for this is Art. 6 para. 1 sentence 1 lit. f) GDPR. Please note that you are entitled to this right of objection (see below “Your Rights”).

If you have given us your consent within the scope of the online survey, we process your personal data on the basis of Art. 6 para. 1 sentence 1 lit. a) GDPR. Please note that you are entitled to this right of revocation (see below “Your Rights”).

3.5         Our ticket shop is managed by a service provider, Eventbrite, Inc., 155 5th Street, Floor 7, San Francisco, CA 94103, Reg. No. 4742147, U.S.A. (“Eventbrite”), with whom we have entered into a data processing agreement.

3.6         Ticket dispatch

The dispatch of the tickets takes place by email and is carried out by Eventbrite. The legal basis for this is the fulfilment of the agreement in accordance with Art. 6 para. 1 sentence 1 lit. b) GDPR.

3.7         Payment in our ticket shop

For payment processing you can choose different payment methods: Credit/Debit, Paypal. In order to offer you these different methods Eventbrite cooperates with different payment service providers who collects and process your personal data during the ordering process. The payment service provider bears the responsibility for your payment data. The processing of the payment data takes place for the fulfilment of your agreement with us, the legal basis being in accordance with art. 6 para. 1 letter b) GDPR.

3.8         Ticket purchase for another person (third party)

If you purchase a ticket for another person (third party), we process the personal data of the third party (pursuant to section 2.4) in order to furnish a personalized ticket and, if applicable, to dispatch the ticket to the third party. The processing of these data is carried out for the purpose of the execution of the agreement on the basis of art. 6 para. 1 sentence 1 lit. b GDPR. You are responsible for ensuring that you are entitled to provide such data and that the person concerned has been sufficiently informed by you about the processing of the person´s data by YET.

4             Your Rights

You can assert these rights as a data subject: the right of access to, the right to erasure and rectification of your personal data and the right to restriction of processing. If you are of the opinion that any data processing has violated data protection law, you have the right to lodge a complaint with the relevant supervisory authority. You can withdraw your given consent to the disclosure of your personal data for promotional purposes at any time and without the need to give reasons with effect for the future. To the extent that data processing is performed on the basis of legitimate interests, you have the right to object.

5             Storage period

In so far as personal data were used for the purpose of establishing a contractual relationship, they are stored for the periods of retention stipulated by commercial and tax laws. In so far as processing is performed on the basis of Art. 6 para. 1 sentence 1 lit. f) GDPR, the data will be erased after we have received your objection and to the extent that processing takes place on the basis of Art. 6 para. 1 sentence 1 lit. a) GDPR after we have received your objection.
